According to Section 3d of The Drugs and Magic Remedies Act, 1954. As per the provisions of this Act, no person shall take any part in the publication of any advertisement referring to any drug in terms of which they suggest cure for certain list of diseases without proper approval by the Central Government of India. Exceptions were provided for cases which required immediate consultation with a “Registered Medical Practitioner”.

If someone assuring a cure for such a disease based on their experience and expertise should approach the Central Government. The Government, after consultation with the Drugs Technical Advisory Board constituted under the Drugs and Cosmetics Act, 1940 (23 of 1940) would acknowledge the person having special knowledge or practical experience in respect of Ayurvedic or Unani systems of medicines deemed fit to suggest the cure to the public.

First time violation of this Law would end up the person in Jail for 6 months and a fine or both. Committing the same violation again would end up the person in Jail for one year and fine.
